Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Morningside booking and appointment-reminder service (the “Service”), operated by Morningside. By creating an account, booking through a Morningside booking page, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Morningside provides service businesses with a booking page and automated appointment messaging, including booking confirmations, reminders, and no-show recovery messages sent by SMS. Businesses (“Providers”) configure their services and receive bookings; their customers (“Customers”) book appointments and may receive related text messages.

2. Accounts

You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your login credentials secure. You must be at least 18 years old and legally able to enter into these Terms.

3. Provider responsibilities

  • You will only collect a Customer’s phone number and consent to text them for appointments you actually provide, and you will honor opt-out requests.
  • You are responsible for your own services, pricing, availability, and any relationship with your Customers.
  • You will not use the Service to send marketing, promotional, or bulk messages, or any content that is unlawful, deceptive, or prohibited by mobile carriers.

4. SMS messaging program terms

Program: Morningside sends transactional text messages related to your appointments — booking confirmations, reminders, and (if you miss an appointment) a message with a link to rebook.

  • Opt-in. Customers consent to receive these texts by checking the SMS consent box when booking an appointment on a Morningside booking page.
  • Message frequency. Message frequency varies based on your booking and appointment activity.
  • Cost. Message and data rates may apply. Morningside does not charge Customers for messages; your mobile carrier’s standard rates apply.
  • Opt-out. Reply STOP to any message to cancel and stop receiving texts. You may receive a final confirmation of your opt-out.
  • Help. Reply HELP for assistance, or contact us at support@mside.co.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

5. Payments

Paid Provider subscriptions, where offered, are billed through our payment processor. Fees are described at the point of purchase. Except where required by law, fees are non-refundable. We may change pricing on prospective notice.

6. Acceptable use

You may not misuse the Service, including by attempting to access it without authorization, disrupting it, reverse-engineering it, or using it to send unlawful, harassing, or unsolicited messages. We may suspend or terminate accounts that violate these Terms or that create risk to the Service or to mobile-carrier compliance.

7. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee that messages will always be delivered, that the Service will be uninterrupted, or that it will be error-free.

8. Limitation of liability

To the fullest extent permitted by law, Morningside will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date, and continued use of the Service after changes take effect constitutes acceptance.
